In March 2015, the Government of India made the text of its revised draft model treaty available to the public. This new model treaty departs considerably from India’s earlier model treaty, India’s existing treaties and model treaties drafted by other countries. However, the limited commentary published so far presents mixed views. As a large developing country with growing economic prominence, India’s new model treaty is expected to be an important contribution to the ongoing debate about the appropriate balance of investor protection and state sovereignty. This article presents an overview of the key highlights of the provisions in India’s new model treaty.
