Defining the exact threshold for distinguishing mere contractual breaches from expropriatory conduct has been troubling international lawyers for more than a century. Some recent investment disputes raised the more specific issue of whether the legitimate exercise of contractual grounds to terminate the contract or to refuse the performance of certain contractual obligations could exclude a finding of expropriation.
